The Tongan offence wouldn't have counted. Under the three strikes law, all the offending involved have to be "serious offences" (as categorised under the statute) and must be NZ-based offences. I think the Herald was just taking the mickey out of him a bit, which is fine by me.

Lawyers in the criminal system love juries. Defence lawyers BS; the prosecutors can appeal to people's stupid prejudices. I'd like to see judge(s)-alone trials. Kinda similar to my experience - spent 3 days waiting to be selected for a trial, got selected for a trial, got selected on the jury, got challenged, trial ended up being delayed for 6 months anyway because the defense insisted on a translator being present. (Ethiopian immigrant domestic violence charges)
