who has right of way at entrance ways/driveways?

pedestrians or cars?

example: walking along a footpath, and a car swings in to a parking building's entrance (without indicating, but let's ignore that fact for now), in front of me, just missing me.

Who had the right of way? If it had been a road/lane/street etc then I don't have the right of way and should be looking out - (no matter what the vast majority of pedestrians think)

But pulling into (or coming out of, for that matter) a driveway/entrance way, who has it right - should the car give way to the foot traffic, or should the walkers give way to the car? Also ignore the "what if" argument of the result of a collision and who would be worse off.

Haven't followed the story closely, that's an interesting point though. Won't be hard to find out, I'll look. The French have a different approach to advertising during tv shows anyway - no constant ad breaks the way we have here, i.e. the news is shown in one go, and then you're stuck with 10 mins of ads after.

i think it depends on the circumstances, but if the driver saw you and still hit you she'd be at fault.

Pedestrians have right of way. There's still a duty of care thing for both the driver and the pedestrian, but if you're walking along and someone just swings into a driveway that you're already on or close to being on and they've given no indication that they were about to do that, then they're most definately in the wrong and they've not exercised duty of care.

Another road question.
The exit onto the main road from my street has a left turn arrow painted on the road, but no 'left turn only' sign. (There is only one lane).

Is it illegal to turn right?

Hrm, heres something from an old Ask Phoebe column (Traffic advise column in NZHerald)

it would be illogical to expect pedestrians to look up and down the road before they crossed every driveway as they walked down a residential street. a footpath is an unbroken path whereas a vehicle turning into a driveway is making a manoeuvre where they should be ensuring the path is clear for them to do so.

i would have kicked the car with my steel cap boot (without leaving a mark). they wont be able to see you doing it, they'll only hear a knock which could have come from anywhere. just continue walking like nothing happened.

Having just read a learners test I can say that one (correct) answer to a question on it clearly indicates you must check the way is clear before entering a driveway of any kind

after indicating for three seconds first

I've always thought pedestrians had right of way on driveways/entrances, they're on the footpath after all. So vehicles should wait for them although, yeah some common sense comes into it.

Year of the Cycos, the new compilation album by Suicidal Tendencies is excellent.

A nice little earner for all you photography buffs. We have just taken our dog to get a santa photo at Animates. I figured we would be the only idiots doing this but alas there were ten people with dogs ahead of us and when we left at least fifteen still waiting.

The prices started at $15 for one photo or $35 for the whole pack. All they had was a skinny santa next to a pretty tree. Wouldnt cost that much to set up and animal lovers were flocking to it.
