It'd be an HR nightmare, but I'd figure there'd be grounds to suggest the allegations alone brought the employer into disrepute, regardless of the question of police involvement.

If Josh in Accounting is publicly accused of rape tomorrow, it'd be a publicity nightmare to both stand by him, or ostracize him. It's a catch 22 completely for the organisation.
